THE Court of Appeals (CA) has dismissed two petitions filed by two groups claiming control over Stradcom Corp., the past information technology service provider of the Land Transportation Office (LTO).
In a 23-page decision penned by Associate Justice Ramon Cruz and concurred in by Associate Justices Hakim Abdulwahid and Romeo Barza, the CA’s 5th Division junked the petitions for certiorari filed separately by opposing factions–the Quiambao group and the Sumbilla group.
The first refers to the petition for certiorari and prohibition filed by Stradcom, through Cezar Quiambao, alleging that the Regional Trial Court of Quezon City, Branch 90, committed grave abuse of discretion in issuing Omnibus Order dated July 19, 2012 and February 20, 2013 in the interpleader case filed by the government, through the LTO.
Specifically, the Quiambao group challenged the ruling of the RTC directing the LTO to deposit with the trial court the amount of contractual obligation to Stradcom.
The second case distinctly filed by Bonifacio Sumbilla of Stradcom assailed an order issued by the RTC in August 2013 holding that it had no jurisdiction over the amount deposited under an escrow agreement, effectively denying Sumbilla group’s motion to enjoin the release of any portion of the amount in held in escrow without court authority.
In its September 1, 2014 decision that was released to the media just recently, the appellate court held that the RTC’s denial of the plea filed by the Quiambao group was in order.
